搶走分居夫新鑰匙妻強制罪罰3千

梁姓婦人與丈夫分居，丈夫獨住在台北市延平北路、梁婦名下住宅；梁婦續保火險，保險公司人員想拍照卻不得其門而入，去年4月7日她帶警察上門理論。梁婦在警察面前強奪丈夫鑰匙，被控妨害自由，士林地方法院依強制罪處她罰金3千元。

婦人表示，她搬家後丈夫就換了門鎖，她要續保火險，丈夫卻不准保險公司進屋勘查，搶走鑰匙只是為了拍照，無強制犯意。

陪同的林姓警員證稱，為了拿到新鑰匙，梁婦搶了2次，第二次終於到手。

法官認為民眾有糾紛，應透過法律程序確定權利存否，不容許藉己之力實現權利，否則無法維持法律基本秩序；該屋鑰匙更新，丈夫為新鑰匙所有權人。
