作家馮光遠在部落格發文批評前行政院文化建設委員會主任委員盛治仁「人渣公務員」。台灣高等法院今天依公然侮辱罪判馮光遠拘役20日確定，可易科罰金。

法院判決指出，馮光遠民國101年12月在部落格發文，「你盛治仁是怎麼回事？...還是你有名譽，可是基本上都是狗屎豬糞名譽，所以妨礙一下也無妨」，隔年又寫「盛治仁這不知所云的人渣公務員」。

盛治仁向法院提起自訴，馮光遠辯稱，他是對可受公評之事善意合理評論，盛治仁花超過新台幣2億元請劇場導演賴聲川創作建國百年音樂劇「夢想家」，箇中值得檢視批判。

一審法院認為，「狗屎豬糞」、「人渣」等文詞已貶損盛治仁人格評價，馮光遠評論超越合理範圍，判處拘役30日，可易科罰金。

全案經上訴，高院認為「人渣」確實有侮辱人格意思，判馮光遠拘役20日，可易科罰金。至於諷刺「狗屎豬糞」部分，高院比照前後文，認定為戲謔文詞，改判無罪，全案確定。(中央社)
