內政部修訂「偶發性及緊急性集會遊行處理原則」，元旦起生效施行。 「偶發性集會、遊行」，無須申請許可。

司法院大法官會議去年3月間做出解釋，認為「集會遊行法」規定緊急性及偶發性的室外集會遊行採「許可制」違憲，違反憲法比例原則及保障集會自由意旨，104年元旦起失效，應由立法者另行修法。

行政院已將「集遊法」修正草案送立法院審議，但立法院尚未完成立法。

為使警察機關因應大法官解釋，內政部訂定偶發性及緊急性集會遊行處理原則，元旦公布施行。
